Agreement
Thank you for being a member of and subscribing to K-Club (in the following referred to as the SERVICE) for ATOM users in Myanmar.
You agree to be bound by these membership terms and conditions (“Terms of Service”) between you and 8 Elements Ltd or any of 8elements affiliates or related companies or business partners which specifically govern the contractual relationship for K-Club and its subscribers and set the way in which our product, service or content may be used, in a legally binding way.
Herewith you accept our general Terms & Conditions, Privacy Policy and other Terms if applicable.

1. SERVICE
The SERVICE is a weekly-based installment service which is activated when you confirm the subscription on the SERVICE mobile site, via SMS, via mobile advertisements, via your selected payment provider or any other possible way.
The subscription to the SERVICE allows you to access the entire catalogue of content for a flat rate of only Ks 550,- per week (WEB/DATA/INTERNET/PHONE connection charges are not included); depending on the Service’s availability and as long as your weekly installment fees are paid.
Your annual subscription to the SERVICE is based on weekly membership installment payments which recur if you have not unsubscribed. You can unsubscribe from the SERVICE at any time (please note the minimum subscription period of 2 weeks) by clicking on STOP subscription or EXIT or CANCEL in the designated “My Account” section. Once you have unsubscribed, you will lose all access to the Content and will not be able to download any Contents, open downloaded contents, play any games online, watch videos or consume any Contents on the Site in whatever way. 8elements reserves the right to end your subscription at will.

2. ELIGIBILITY
This service is available to ATOM subscribers in Myanmar only.

3. ACCESS TO THE SERVICE
In order to gain access to the SERVICE, you will first need to click on Join Now or Confirm on any banner, mobile advertising, landing page, any website advertising the SERVICE or the mobile site itself. You can also subscribe by responding to USSD menu messages or sending SMS confirmations from your own mobile phone. You will then be charged 550 Ks for that week. Following that, you can access and enjoy the SERVICE. Every week, you will be charged 550 Ks. You will be a member of the SERVICE until you unsubscribe.

4. PAYMENTS
You, the subscriber, will be charged Ks 550.- each week on your phone bill. If you are a prepaid user, please ensure that you have enough credits on your prepaid card before you subscribe to the SERVICE.
When there is not enough credit on your prepaid card and your weekly membership fee is due, we implement a step-down charging mechanism to charge you Ks 57.14 for one day access.
In case you do not pay your weekly membership installments, you will not be able neither to access your downloaded Contents nor download any new Contents nor access any Contents online. Once your weekly fees can be charged, your membership will be activated again.

5. PERSONAL INFORMATION
You have the right to gain access, amend and/or oppose the communication of data by 8elements on yourself regarding the SERVICE and your membership on request by writing to 8 Elements Ltd at Unit 901, 9/F. New Mandarin Plaza Tower B, 14 Science Museum Road, Tsimshatsui East, Kowloon, Hong Kong SAR.

6. MODIFICATIONS
8elements reserves the right to change these Terms of Service at any time at its own discretion.

7. GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of Myanmar. You, as a subscriber, irrevocably consent to the exclusive jurisdiction of the Myanmar courts notwithstanding the jurisdiction where you are based.

8. ADDITIONAL MEMBER BENEFITS
Please note that all promotional member benefits, if there are any on offer on the Site, are valid for a limited period of time. For all contests, competitions, quizzes, leaderboards and promotions, please check online at respective special pages and/or partner sites for detailed terms & conditions. Any draws or judges’ decisions are final and no correspondence will be entertained.
Any prize, award, credit or refund which is not claimed within 1 month will be forfeited.

9. SPECIFIC TERMS FOR THIS SERVICE
K-Club is designed as an “all-you-can-watch” buffet SERVICE where you can consume almost as much ad-free premium Content as you desire, so long as you stay an active member and continue to pay for your subscription every week.
Please note that the minimum subscription period is 2 weeks.
If you unsubscribe within the first 2 weeks of your subscription and you are enjoying a First Week Free or Trial or otherwise free offer, you will be blacklisted for a period of 2 weeks and after 2 weeks, you will then be allowed to subscribe again to the SERVICE.
In case you stay inactive and do not visit the SERVICE site for a consecutive period of 24 months (twenty-four) we will unsubscribe you automatically and you will be notified by service SMS.
Any references to ‘downloads’ and related activities are not applicable for i-phones and other iOS-based devices.

10. ATOM GENERIC KEY TERMS OF SERVICE
The service will be eligible to use for 365 days with daily/ weekly/ monthly installment fees based on the service type you choose.
The ATOM collected fees for the use of the service are either based on the usage frequency for one time (for example, daily use and you pay once only) or based on the installment billing method (e.g. weekly /monthly charges based on 365 days of the service usage).
If an ATOM partner (third party) provides/serves a trial period for their service, customers can enjoy the trial period till the expiry date. Then, you may be charged based on your chosen service even after the trial period is expired. And you will get charged from your mobile balance for the daily/ weekly/ monthly service fees after the trial period ended.
You confirm that accessing the service based on these Terms of Service and Fees serves as recognition and acceptance confirmation.
By clicking subscription or confirmation you are accepting the Terms and Conditions of the Service used.

11. TERMS AND CONDITIONS OF THE K-FUN PRIZE PROGRAM
The K-Fun reward program is a prize program for K-Club customers who have subscribed to K-Club and collect points for the chance to win rewards every week.
Program period: 1 May 2024 - 31 December 2024.

Winners must have an active subscription and cannot join in suspended or pending memberships and/or when redeeming the prize.
Each MSISDN is entitled to enter 1 registration only.
Customer points will be reduced according to the points exchanged for gift rewards.
If a customer unsubscribes, the points will be forfeited.
Customers who successfully redeem prizes will be contacted by the organizer within a maximum of 3 days for the validation and verification process of winner data.
Prizes cannot be exchanged for cash.
The prize will be sent to the winner within a maximum of 14 days after the winner's data verification process is complete.

This program applies to Atom customers who have registered as telecommunications service customers in accordance with applicable laws and regulations.
